Welcome to CPC Institute, the website and online service of HOW TRUST and its consultants department CPC Institute ("CPC Institute " "we," or "us"). CPC Institute does not provide medical treatment or medical advice and does not diagnose or treat any disease or condition. This page explains the terms by which you may use our service. By accessing or using the CPC Institute, consultation provided through or in connection with the CPC Institute service , you signify that you have read, understood, and agree to be bound by this Terms of Use Agreement, whether or not you are a registered user of our Service.

CPC Institute does not provide medical treatment or medical advice and does not diagnose or treat any disease or condition. The consultant that works with CPC Institute possess MD medical, Psychiatric, Psychoanalytic, and Substance Abuse credentials and who has been Board Certified by the AMERICAN BOARD OF PSYCHIATRY and NEUROLOGY with Special Qualifications in Addiction Psychiatry.

CPC Institute does not offer nor provide the practice of Medicine, Psychiatry, Psychoanalysis, or Substance Abuse treatment. Likewise the nature of the contractual relationship for the participants in CPC Institute is not a doctor-patient relationship but rather only that of a teacher Consultant Ė Candidate Contract. The information acquired from consultants of CPC Institute is not intended to substitute for obtaining medical/psychiatric advice from competent independent medical/psychiatric practitioners in a relevant specialty.

The Health Insurance Portability and Accountability Act (HIPAA) of 1996 (P.L.104-191) [HIPAA] was enacted by the U.S. Congress in 1996. Title II of HIPAA, known as the Administrative Simplification (AS) provisions, requires the establishment of national standards for electronic health care transactions and national identifiers for providers, health insurance plans, and employers.

The Administration Simplification (AS), Title II of HIPAA provisions also address the security and privacy of health data. The standards are meant to establishing the widespread use of electronic data interchange in the U.S. health care system.

Treatment or counseling with practioners of Medicine, Psychiatry, Psychoanalysis, Psychological or Substance Abuse counseling with associated rehabilitation counseling and treatment hospitals are under the Title II of HIPAA, Administrative Simplification (AS) provisions, which mandates that all records be digitized and distributed immediately in real time to some 600 federal and state agencies. This is authorized legal sharing of the treatment information and participants.

Treatment, counseling, and rehabilitation facilities and practioners have become under legally required Administration Simplification Title II of HIPAA are covert Confidential Informants (CI) for releasing and documenting all private data related to the patientís data, without informing the patient of that status to an estimated 600 federal and state governmental agencies as authorized disclosure under the HIPAA Title II provisions.

The medical/psychiatric, counseling treatment should be done with your having the full disclosure and knowledge and expectation that you let your hair down, and tell the truth the whole truth and nothing but the truth, knowing the information could be used against you in a Court of Law. The defacto violation of the Fifth Amendment right for Self Incrimination if voluntarily done willingly is functionally set aside allowing, for instance, a full confession for medical treatment and complete abrogation of his Miranda Rights. HIPAA Notice of Privacy and Confidentiality does not mention specifically when treatment is rendered which of the authorized 600 federal and state agencies the information will be routinely released to without the patientís specific Release of Information to each respective agency

We reserve the right to amend this Agreement at any time and without notice. If we do this, we will post the amended Agreement on this page and indicate at the top of the page the date the Agreement was last revised. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms of Use. If you do not agree to any of these terms or any future Terms of Use, do not use or access (or continue to access) the Service. This Agreement applies to all visitors, users, and others who access the CPC Institute Service.

You are solely responsible for the activity that occurs on your account, and you must keep your account password secure. You must notify CPC Institute immediately of any breach of security or unauthorized use of your account.

The CPC Institute service is subject to scheduled and unscheduled service interruptions. All aspects of the Service are subject to change or elimination at CPC Instituteís sole discretion. CPC Institute reserves the right to interrupt the service with or without prior notice for any reason or no reason. You agree that CPC Institute will not be liable to you for any interruption of the service, delay or failure to perform.

Children's Privacy

CPC Institute is committed to protecting the privacy of children. The Professional Sites are designed and intended for use by adults, and are not intended for, nor designed to be used by children under the age of 18. We do not collect from or provide to any person we know is a child under the age of 18.

Eligibility

This Service is intended solely for Users who are eighteen (18) years of age or older, and any registration, use or access to the Service by anyone under 18 is unauthorized, unlicensed, and in violation of this Agreement.

Consumer Responsibility

Consumers who use the tools or databases do so at their own risk. Individuals with any type of medical condition are specifically cautioned to seek professional medical advice before beginning any sort of health treatment. For medical concerns, including decisions about medications and other treatments, users should always consult their physician or other qualified healthcare professional.

Laws that Govern this Agreement

HOW TRUST and its department of consultants CPC Institute control those components of the Service made available through their respective Web sites from their offices within the state of Texas in the United States of America. The CPC Institute can be accessed from any of the United States and from other countries worldwide. Since the laws of each State or country able to access the CPC Institute may differ, by accessing the CPC Institute service, you, CPC Institute agree that the statutes and laws of the state of Texas, without regard to choice of laws principles, will apply to all matters relating to use of the Service. No waiver of any of these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or any other term or condition.

By accessing materials through the Service or registering you agree with all the terms and conditions of these Terms of Use. We reserve the right, in our sole discretion, to change these Terms of Use from time to time, and your continuing use of the CPC Institute service constitutes your acceptance of and agreement to any changed terms and conditions.

Cause for termination shall include, but not be limited to, (a) breaches or violations of these Terms of Use or other incorporated agreements or guidelines, (b) a request by you (self-initiated account deletions), (c) discontinuance or material modification to the Service (or any part thereof), (d) unexpected technical or security issues or problems. You agree that all terminations for cause shall be made in the sole discretion of CPC Institute, as applicable, and that CPC Institute shall be liable to you or any third party for any termination of your account. CPC Institute Billing Policies


CPCI Consultation Admission Entry Fee

The fee for CPCI consultation is $ 2/minute of consultation. The standard unit is 50 minutes of actual clock time with the consultant. The fee is paid in cash on admission to the consultation and any less/more time spent is either charged at the next consultation or carried as an escrow credit for the next consultation. The admission will be received before the consultant appointment can be made by CPCI. The First Appointment Fee is totally refundable after the consultation at the candidate request and for any reason.

At any time after the first appointment, for any reason the, escrow on balance can on request be returned to the Candidate. The fee will be paid under a CPCI assigned USER NAME and PASSWORD with an assigned ACCOUNT NUMBER. The account will be recorded only under the CPCI assigned identification and a printed report of the amount, balance, or escrow credit will be available on request. The standard fee per 50 minute session is $100.00 and provided before the consultation is begun as an admission fee. The method of reflecting the account balance will be individually arranged between CPCI and the candidate reflecting his/her personal individual private requirements. At no time will invoiced billings or requests for payment be sent the Candidate. All consultation services are rendered by appointment after the admission entry fee has been paid.

The Candidate's actual name, address, and other identifying data is not requested, received or recorded and no records will be kept except the CPCI assigned USER NAME, PASSWORD, and ACCOUNT NUMBER. The absolute financial privacy will be maintained at all times for this matter for the candidate. The cash may be sent by courier/certified/registered delivery to the mailing address of HOW for immediate credit to the numbered account under the CPCI assigned USER NAME, PASSWORD, and ACCOUNT NUMBER for the Candatesís account.

Should the Candidate request payment of the admission fee by some other form of payment he/she will be informed that privacy may be compromised by that form of payment. VISA/MC/AMERICAN EXPRESS/DISCOVER credit may be accepted or money order. The PAYEE will be HOW only with the designated account number. On the credit card statement the vendor name will be HOW, only. The Department of HOW, CPCI, will not be reflected on the credit card statement.

Wire transfers, SWIFT account transfers between businesses, Money Orders payable to HOW with designated account number, may be made on individual instructions and request of the candidate. At no time does CPCI provide any consultation or other services that are tax deductible in any jurisdiction. All funds therefore must be paid from after tax discretionary funds.

Personal checks of the individual are not accepted, but consultation fees charged to a business entity that do not reflect the name and position of the candidate will be accepted.

After the first consultation any escrowed retainer on credit balance will be charged on a $ 2 per minute basis which is deducted at the time of consultant time and is non-refundable. Any credit residual balance is noted and refundable at any time in any method designated by the candidate. The admission fee for the first consultation is always cheerfully refunded if the candidate once having the consultation decides this is for any reason not going to be of use to meet his/her needs or requests and expectations.

METHOD OF PAYMENT PRIVACY POLICY

CPCI is specific in protecting the personal privacy of the candidate, and no data regarding the candidate will be received, cataloged, recorded or reflected in the account transactions that take place. The model is collection of cash on admission for a consultation conference at the admissions door cashier cover charge in for example a theater or conference hall.

It is recommended that you send $ 100 -$ 500 originally as a consideration of escrow deposit. It is recommended that you send cash only by courier, certified mail, or restricted delivery with a RETURN ADDRESS to one of your companyís name only addressed to GENERAL USPS OR COURIER DELIVERY facility, not reflecting your physical address. This provides maximum private financial communication.

If you choose you may also use WESTERN UNION wire transfer to HOW account as information for SWIFT transfer provided, or USPS Money Order reflecting only CPCI assigned USER NAME, PASSWORD, and ACCOUNT NUMBER.

At no time will statements, bills requesting payments be sent by mail or by wire as CPCI will not have the address or billable location and identification on file or available. This is further to protect personal privacy of the candidate in that mail may be received to a family or business that may be read by staff or family members at the location.

If residential consultation is provided, special individual arrangements will be made by CPCI for the candidate and any accompanying staff or family members. Full language translation services are available for residential candidates on request.

No Refund

You may cancel your CPC Institute Account at any time; however, there are no refunds for cancellation. As permitted under the terms of this Agreement, CPC Institute has the right at any time for any reason or no reason to suspend or terminate your Account, terminate this Agreement, and/or refuse any and all current or future use of the CPC Institute service without notice, refund, obligation, or liability to you. In the event that CPC Institute suspends or terminates your CPC Institute Account or this Agreement there will be no refunds of services already performed after the original 5 (day) initial period.

No Refund

You may cancel your CPC Institute Account at any time; however, there are no refunds for cancellation. As permitted under the terms of this Agreement, CPC Institute has the right at any time for any reason or no reason to suspend or terminate your Account, terminate this Agreement, and/or refuse any and all current or future use of the CPC Institute service without notice, refund, obligation, or liability to you. In the event that CPC Institute suspends or terminates your CPC Institute Account or this Agreement there will be no refunds of services already performed after the original 5 (day) initial period.

Security

CPC Institute has implemented commercially reasonable technical and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, use, alteration or disclosure. However, we cannot guarantee that unauthorized third parties will never be able to defeat those measures or use your personal information for improper purposes. For that reason CPC Institute does not collect any personal any personal information such as your name, address, business, associated cell phone, email, URL web address, or any information about a Candidate in CPC Institute as a registered enrolled participant.

Additional Representations and Warranties

The enrolled Candidate shall be solely responsible for your participation, you affirm, represent and warrant, in addition to the other representations and warranties in this Agreement, the following:

You are at least 18 years of age.

Indemnity

You agree to defend, indemnify, and hold CPC Institute , their respective officers, directors, employees, agents, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms of Use.

You agree to defend, indemnify and hold harmless CPC Institute and its subsidiaries, agents, managers, and other affiliated companies, and their employees, contractors, agents, officers and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the CPC Institute Service, including any data or content transmitted or received by you; (ii) your violation of any term of this Agreement, including without limitation your breach of any of the representations and warranties above; (iii) your violation of any law, rule or regulation of the United States or any other country; or (iv) any other partyís access and use of the Service with your unique username, password or other appropriate security code.

No Warranty

The service is provided on an "as is" and "as available" basis. Use of the service is at your own risk. The service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Without limiting the foregoing, CPC Institute, and CPC Institute does not warrant that the content is accurate, reliable or correct; that the service will meet your requirements; that the service will be available at any particular time or location, uninterrupted or secure; that any defects or errors will be corrected; or that the service is free of viruses or other harmful components.

Limitation of liability

The CPC Institute service is controlled and operated from its facilities in the United States. CPC Institute makes no representations that the Service is appropriate or available for use in other locations. Those who access or use the CPC Institute service from other jurisdictions do so at their own volition and are entirely responsible for compliance with local law, including but not limited to export and import regulations. Unless otherwise explicitly stated, all materials found on the Service are solely directed to individuals, companies, or other entities located in the U.S.

Entire Agreement/Severability

This CPC Institute Agreement, together with any other terms you agree to in connection with your use of the CPC Institute Service, shall constitute the entire agreement between you and Goodreads concerning the Service. If any provision of this CPC Institute Agreement is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of this CPC Institute Agreement, which shall remain in full force and effect.
Please indicate below whether you agree to the following:
  1. As medical, psychiatric, psychological, or counseling treatment advice must be tailored to the specific circumstances of each case, and laws are constantly changing, nothing provided through registration as a Candidate with CPC Institute should be used as a substitute for the advice of competent professional in their respective disciplines.
  2. You agree that the information provided by CPC Institute may not be appropriate for your particular needs and are offered for informational purposes only. The CPC Institute does not provide diagnosis and treatment of any disease or condition.
  3.  With the CPC Institute there is no doctor/patient relationship or diagnosis or treatment of any disease or condition is created between you and CPC Institute and any Consultant associated with the CPC Institute by your registration and/or use of any information or educational materials provided by CPC Institute.
  4. CPC Institute provides Candidates with access to a wide variety of resources through their respective professional Web sites including, but not limited to, articles, reference tools, and continuing education for medical professionals, communication tools, and message boards. The use of the Service is at your own risk and the Service and the content are provided on as "AS IS" basis.
  5. The materials and consultation comprising the CPC Institute consultation service virtual office are provided by CPC Institute as a service to its readers on an "as-is, as-available" basis for informational purposes only. CPC Institute assumes no responsibility for any errors or omissions in these materials. CPC Institute makes no commitment to update the information contained herein. For medical concerns, including decisions about medications and other treatments, users should always consult their physician or other qualified healthcare professional.
  6. CPC Institute makes no, and expressly disclaims any, representations or warranties, express or implied, regarding the CPC Institute , including, without limitation, any implied warranties of merchantability or fitness for a particular purpose. CPC Institute makes no, and expressly disclaims any, warranties, express or implied, regarding the correctness, accuracy, completeness, timeliness, and reliability information. Under no circumstances shall CPC Institute Department of its owner HOW TRUST , or any of their respective partners, officers, directors, employees, agents, associates or representatives be liable for any damages, whether direct, indirect, special or consequential damages for lost revenues, lost profits, or otherwise, arising from or in connection with this CPC Institute consultation with the virtual office or associated materials generally.
